Background On This Country


The Peru Truth and Reconciliation Commission (TRC) was convened in July 2001 to investigate human rights abuses that occurred between 1980 and 2000, contribute to justice, and make recommendations. The TRC's final report, issued in August 2003, found that insurgent violence and counterinsurgency tactics caused an estimated 69,000 deaths and disappearances, mostly in indigenous communities. The Commission recommended a comprehensive reparations plan, criminal prosecutions, and a series of other measures. Subsequent criminal investigations and prosecutions have faced obstacles, including uneven treatment and assertions of procedural impediments, even though Peru's Constitutional Tribunal confirmed the right to the truth and the inapplicability of statutes of limitation in disappearance cases.

Lisa Magarrell and consultants continued to provide technical assistance to the TRC in its final months, including extensive work on the issue of reparations. Since September 2003, a Lima-based consultant has monitored and reported on post-TRC developments; a weekly bulletin, produced in collaboration with the Association for Human Rights (APRODEH), has 300 national and international subscribers. Paul Seils provided information to NGOs and prosecutors on the techniques and strategies of massive crime investigation, and in June 2004, a consultant from Guatemala initiated a six-week project with APRODEH to aid and assess its work on prosecutions. The ICTJ will continue to provide technical assistance on post-Commission criminal justice issues and implementation of reparations, while tracking the post-TRC process and analyzing lessons to be learned.
